    After signing on earlier this year, and not being paid by Ray Vierheller who has told me every excuse imaginable, I contacted Wright Tools and a reply from Ty Smith, Marketing manager, wrote me back the attached below. This is just an FYI for racers who might consider signing on to Ray's "Wright Tools" program in the future.

    I received your recent enquiry about our relationship with Vierheller Racing (Ray). I understand your frustration as we have had numerous complaints about Ray's program. We ended our support of the program at the end of 2011. The program that Ray ran was never corporately supported by Wright Tool other than providing the tools that he would order from us. Unfortunately, there is nothing I can do on our part since we ended our approval of the program at the end of 2011. As of January 31st, 2012, Vierheller Racing was no longer to purchase product as a distributor of Wright Tool, so I am not sure who he was working with to get the product for the program. That is all of the information I have for you right now.

    Jeff, I've been listening to this Wright Tools / Vierheller story for close to two years now.. it is also a hot topic on other race forums and I've found that it has affected racers in all classes, both in NHRA and IHRA.. many that I know personally..

    There are many big name racers affected by this, and tens of thousands of dollars owed, missing, misdirected, or misused.. but I never hear of anyone taking any affirmative actions to go after the responsible parties, either in a civil action or criminal action.. it can run the gambit from breach of contract (civil) to fraud (criminal).. YUP, bouncing checks is fraud (criminal)..

    Now Wright Tools tells you that they are well aware of the problems (admission), have severed ties with Vierheller as of January 2012, and are sorry but there is nothing they can do.. WTF!!!.. in MY OPINION, Wright Tools has an obligation to the racers involved prior to January 2012 (by admission), and by whatever means of contract or agreement (written or verbal), Vierheller was acting as their agent.. Vierheller has an obligation to those who signed (implies contract) after that date.. Vierheller should also be made to provide an accounting of any funds that he had control of pertaining to his signed agreements..

    If I was in your position, or that of the many racers burnt on this deal, I would be getting all those affected racers together, consulting a criminal attorney with a background in business, and making notifications to the responsible parties through the attorney that it's GAME OVER.. there are severe consequences to go along with their actions..civil, criminal, and IRS..

    I would also go as far as to petition NHRA and IHRA for sanctions against the parties until this matter is cleared up.. meaning Wright Tools can not advertise in publications of either body, or sell products at any events sanctioned by those bodies, and Vierheller can no longer race at any venues or events sanctioned by those bodies..

    NOW.. these are just MY OPINIONS, and advice on what I would be doing if I was affected by this scam, and you can think about it or not.. but like I said, I've been hearing it for two years now and if you guys don't take action, we'll be hearing about it for years to come..

    But I will say this, Jeff.. I would probably spend more than what is owed to stop a racer from burning fellow racers.. and I know from the buzz in the pits about this issue, I am not alone..

    Thank you for your great reply Charlie, and I do agree with your opinions. I am working with Wright Tools as they are issuing a statement and ultimatum to Ray. I will keep you posted with what transpires.

    There is also another avenue to follow, and that is Ray had said he intends on racing Division 1 next year. I believe there a few racing "friends" I know back there that might want to stop by and say hello to him.

    Best of luck, Jeff, and I hope that Wright Tools comes through to not only right your wrong, but everyone elses too..

    Please keep us advised as we can then keep other affected racers in the loop.. I know that I will be communicating with those that I know..

    I'm wonder how happy NHRA will be to learn that someone was running a contingency program at NHRA races and NHRA wasn't getting a piece of the action!

    Good Morning Jeff,

    My google alerts tell me that Ray's contingency program has upset a lot of people on some of the racing forums. I'll do my best to describe some background, and the actual specifics of the program we had set up with Ray, and the reason we ended it. I'm also trying to clear our name here, because I have given Ray every opportunity to clear it on his own, and he won't respond to us either.

    Background:

    Wright Tool isn't traditionally a well known tool brand in the "automotive" market. The primary reason for this is that this market is flooded with "truck" brands such as Snap On, Mac, Matco, Cornwell, etc. that have trucks that travel around to various automotive shops and race shops to sell their tools. Wright focuses on heavy duty markets such as Oil/Gas, Mining, Power Generation, and HD Construction, and we sell our products through industrial distributors such as Fastenal, Grainger, and thousands of local industrial distributors world wide. We do not advertise or promote in any racing venues whatsoever. No magazine ads, no track signs, no semi's, no hospitality tents, etc. Wright had a local relationship with Ray Vierheller , and Ray pitched an opportunity to give racers a high quality, U.S. Made hand tool option different from the truck brands. The structure of the program that Ray proposed to us is below.…

    Program:

    Ray would become a distributor of our products, and would purchase our products at distributor pricing. Ray would receive a "buy-in" to the program from the racers, which structure was presented to us by Ray below. The buy-in would qualify the racers for the exact amount of product from us, in which Ray would purchase from us at a distributor cost.

    Structure:
    Initial awards program cost to the racer is $200.00. With this $200.00 investment, the racer would receive a $200.00 credit toward the purchase of Wright Tools, and a decal to display on each vehicle they race.
    Each $500.00 increment spent qualifies them for an additional payout for a win or runner-up performance.
    Up to $500 in purchase = $200.00 win, $100 runner-up
    Between $500 and $1000 = $300 win, $150 runner-up
    $1k to $1500 in purchases = $400 win, $200 runner-up and so on…
    ** Keep in mind, these ^^ payouts were supposedly coming from the initial investments that racers make. At no point in the program was there ever cash paid to Ray from Wright for any contingency. We were strictly selling product to Ray for which those in the program purchased from Ray. It seems to me that Ray was banking on two things… 1) Racers not cashing in on their $200 worth of product and building up a "bank" and 2) Signing up enough people that only a minimal amount would earn the bonus money.

    Long story short from our side, we signed Ray up as a distributor, and sold him product when he sent orders in, period. Distributors are not agents of Wright Tool. They purchase product from us, the manufacturer, and sell to the end user. We ended Ray's distributorship on Jan 31st, 2012 when we started getting complaints of racers not getting paid from Ray, and we didn't want our brand associated with that. We're an 85 year old, family owned, US Made hand tool company, and it has taken us a long time to build our brand. It's hard enough to succeed as a US tool manufacturer with all of the import product flooding the market daily. Some people don't care about that, and are only interested in how they can take advantage of other people's hard work. I feel our generosity to even set Ray up as a distributor was taken advantage of, not to mention how he has taken advantage of all of the racers in the program. Ray won't answer our requests to respond to this issue either, and after all of the racers he has upset, it baffles me that he actually shows up at the races. I have given Ray every opportunity to clear our name from his mess, and he hasn't. I'm sure the racing community will make sure that Ray isn't able to scam any more money from racers since it seems they are a very tight knit group, and hopefully no other Manufacturers fall for the scheme either. I will also say this. The racers aren't the only group that Ray owes money to. If anyone would like to talk to me more about this issue, they can contact me directly using the information below.     Lot's of emails and phone calls

    Wow -

    I wanted to say I can't believe how many people have contacted me with their stories about Ray Vierheller. But after hearing soo many, I guess I can believe it.

    I spoke with an attorney that deals with type of thing (specializing in motorsports contracts) and he mentioned if I start litigation, there is a way to ban him from participating at NHRA sanctioned events.

    I will keep you posted.

    If i was Ray i would be way to embarressed to show my face at a race . The wright tool co. should step up to the plate and make some type of restitution with the racers that lost money . We looked at the program and thought we dont win enough to make it pay off so we didnt buy in . When we win is few and very far between so that kind of program needed more guys like us and everbody would have been happy .

    HEY CHIP!!.. unfortunately, I'm not an attorney.. just one of those guys whose career paralleled, and worked closely with them.. BUT, if I was, I would be handling this case Pro Bono, (FREE).. IMAGINE THAT!!!

    JEFF.. I'm glad to hear that people are reaching out to you on this issue, and hopefully some of the legal expenses can be shared.. and I'm also glad that your attorney agrees with me on the NHRA sanctions.. I'm sure that many Division Directors will be consulted moving forward..

    ...heard a rumor this week that tha reason that BB ain't gonna have a calendar this year is cause of the Wright Tool Fiasco, don't quote me here but...i will be totally lost without a BB calendar this year, it is the Comp Industry Standard information source for racing as i know it, lmao....

    The main reason, I suspect ,that there may not be a new calander this year is the fact that Ray Vierheller was the guy who put the previous calanders together for Brian. Not a good situation right now. Maybe something will change in the future and the calanders will be back.

    I had received an email from Ray back on November 13 about preordering a comp calander for this year. So they may be out there I just chose not to take another chance with Ray.

    SOOOOOOO, the question would be at this point, how many guys pre-paid for their copies of the calender, and how much??.. I would like a list so I can come up with something so I can run Comp on your dollars.. IMAGINE THAT!!!

    Charlie ,, I was thinking the same thing as you when Mark mentioned preordering calenders from a questionable source, The mind of a Dirt Bag never quits skeeming on how to scam people whether he knows them or not. Also Wright Tools should step up and clear this problem because there name is tagged to this forever altering their image unless they come clean with all involved

    There must be one coming, Charlie.. I' ve already heard from a few people that sent money.. but they were supposed to get them before Christmas too, we just don't know which Christmas..
